Dispute Resolution Service:

DNS disputes should be rare once the proper registration guidelines are followed. In the UK less than 0.05% of all registrations of the .uk TLD end up in dispute (Nominet, nd).

Some Registration Authorities have put polices and procedures in place to help deal with disputes quickly without having to resort to the Courts. An example of one is the UK"s registration authority, Nominet, who have set up a dispute resolution service whose role though it does not replace the Court system, may make decisions that are binding. It has the power to transfer, cancel or suspend the Domain Name registration if it finds against its registered owner.

Ireland's registration authority at present does not have a dispute resolution service but is looking at the possibility of setting up such a service.

However, a dispute may arise when one party feels they have a greater right to use a Domain Name. The Dispute Resolution Service (DRS) offers an efficient and transparent method of resolving disputes in the .uk Top Level Domain.

Ireland has been assigned the TLD of .ie by the Internet Corporation for Assigned Names and Numbers (ICANN) and use of this TLD is controlled under Irish legislation in the Electronic Commerce Act, 2000. Under this act the Minister has the power to:

  • Designate registration authorities
  • Control the circumstances in which registration is granted, renewed or refused
  • Control the time period of each registration
  • Control registration fees and the manner in which fees are paid
  • Control the appeal and the appeals process
  • Set out a fine for non compliance of the registration system [Max Punt500 / Euro635 on conviction]
